1.0.      The = procedure=20 which would be followed for the year 2007 for :

 

K           = ;      =20 submission=20 of programmes for movement of coal under Priority C of the Preferential = traffic=20 order of the Ministry of Railways, and

K           = ;      =20 allotment=20 of coal rakes are delineated in the following paragraphs.

 

1.1.           = ;=20 Coal=20 can move under Priority C and Priority D of the Preferential Traffic = Order=20 issued by Ministry of Railways. The office of EDRM will deal with only = movement=20 under Priority C. Movement under Priority D will be dealt with by the = Railway=20 zones in accordance with procedures laid down by the Railway=20 Board.

 

1.2.          =20 =93Sponsorship=94=20 for movement of coal by Rail under Priority C to various consumers is no = longer=20 required. However, for industries such as power (including captive power = plants), export, integrated steel plants, cement, fertilizer, Railways = and=20 defence, collectively called =93core sector=94 the existing system of = linkages and=20 recommendations for movement by the concerned ministries and agencies = shall=20 continue. The linkages and/or recommendations by ministries/entities = shall=20 constitute the ceiling limit for sanction of pgrammes, which should be = submitted=20 after consent and signature by authorized signatory of the concerned = Coal=20 Company. For industries other than those in the core sector, programmes = duly=20 consented by authorized signatories of the coal companies would have to = be=20 submitted to the office of EDRM for sanction. No other document would be = required. For movement of imported coal, washery rejects etc., procedure = for=20 submission of programmes and issue of sanction is described in the = following=20 paragraphs.

 

1.3.          =20 The=20 consent issuing companies/coal companies should submit a fresh list of = specimen=20 signatures to the office of EDRM, which will be valid for the calendar = year.=20 Till such time the fresh list of specimen signatures is received, the = existing=20 list shall be honoured. If there is any change in the signatory, this = office=20 should be immediately informed.

 

1.4.          =20 Each=20 programme consisting of six printed copies duly consented by = subsidiaries of=20 Coal India should be furnished to EDRM=92s office. If there is any = correction to=20 programmes, the same must be countersigned with date by the Coal Company = issuing=20 consent and the office seal affixed.

 

1.5.          =20 Under=20 the Preferential Traffic Order, the classification of coal consuming = industries=20 into various categories such as Engineering, heavy Chemicals etc. is no = longer=20 available. Hence all non-core sector programmes shall be clubbed under = one=20 omnibus category =93non-core=94. Programmes under non-core sector = categories will be=20 sanctioned as per receipt of the consented programme. At the closing = hours of=20 the office, the programmes will be sent to rake section for allotment = assigning=20 seniority as per receipt serial only (viz. Non-core-1, Non-core-2=20 etc).

 

1.6.          =20 Programme=20 for movement of hard coke, washed and jhama coal/coke fractions=20 (Nut/Pear/mixed/Breeze coke) would be sanctioned on the basis of = detailed=20 procedure, which has been notified separately. Please see Annexure A to = this=20 circular.

1.7.           = ;=20 (a)   Programmes for washery = middlings=20 shall be sanctioned by the EDRM=92s office, if Coal controller=92s = clearance is=20 available.

(b)  Programmes for movement of = coal lines,=20 washery rejects, coal slurry, tailings from washeries shall be accepted = from:=20 (a) Recognised coal companies for their respective washeries, (b) = recognised=20 washery operators already dispatching washed coal by Rail, (e) = recognised user=20 of coal who is receiving coal by Rail and is processing it for his own. = Such=20 programmes will be sanctioned by EDRM provided they are accompanied by = the=20 following documents:

K           = ;      =20 An=20 undertaking from the consignor that the traffic offered for movement = comprises=20 of washery rejects or slurry or tailing liability for any verification = in the=20 specification, will rest with the consignor.

K           = ;      =20 If=20 the programmes is submitted by a washery being operated by a recognized=20 washery/other washery operator, it must be accompanied with a = declaration that=20 for sake of such by product, the washery operator possesses necessary = copy of=20 agreement with various parties on whose account the raw coal has been=20 transferred to the washery operator for its = beneficiation.

 

1.8.           = ;=20 Policy=20 for movement of non-linked washed coal for core & non-core section=20 :-

 

(A)    = Raw=20 coal procured by the core & non-core sector consumers directly from = Coal=20 Company under e-marketing system and sent to washery by Road/Rail for=20 beneficiation, the following documents have to be submitted by the = washery=20 operator (I) The washery operator must give a declaration that the = additional=20 quantity of washed coal, beyond the linked quantity approved by = SI.C(ST), which=20 is being offered, the raw coal has been procured by the respective core = sector=20 consumer/consumers from the open market under e-auction scheme. (ii) the = programme for such movement may be submitted by the washery operator on = behalf=20 of the core sector consumer/consumers, at the beginning of the month = with the=20 zonal Railway/Office of EDRM, as the case may be indicating the quantity = of raw=20 coal procured by the respective consumer/consumers under e-auction = scheme.=20 (iiii) On the basis of approved programme, = the indents=20 may be placed by the washery operators on behalf of the = consumer/consumers for=20 movement of such washed coal accordingly. (iv) Copy of delivery order = issued by=20 concerned coal companies (v) No objection Certificate from concerned = Coal=20 Company by mentioning quantity of coal and movement of washed coal by=20 Rail.

(B)  =20 Raw=20 coal procured by the washery operator directly from Coal Company under =          e-marke= ting=20 system and movement of washed coal after its beneficiation to the core = &=20 non-core sector consumer. The following documents have to be submitted = (I)The=20 documents as mentioned under para (A) i to iv (ii) Actual despatch against the Delivery = Order=20 issued by the concerned coal company to the washery operator must be = certified=20 by the colliery/concerned coal company.

 

1.9.      = Programme for=20 movement of imported coal/coke:

 

K           = ;      =20 Application should be furnished in the = prescribed=20 format (specified vide this office order No.CMP/5/2005 dated = 11.05.2005).

K           = ;      =20 No=20 change in the format will be entertained.

K           = ;      =20 Consignor/consignee/importer/consumer=20 should furnished list of specimen signatures of the official authorized = by the=20 company to submit programmes to EDRM=92s office.

K           = ;      =20 Applicants=20 should directly submit applications to the office of = EDRM.

 

1.10.    Programme under=20 e-marketing system of subsidiaries of CIL :

 

K           = ;      =20 Programmes=20 shall be accepted for all categories of consumers, viz, core, non-core. The programmes should be = clearly marked=20 as e-marketing by the coal company.

1.11.       =20 Clarification=20 Regarding some Unloading Points :

 

a)     =20 If=20 a rake is bieng programmed for movement to a = seaport,=20 a declaration should be submitted along with the programme that a plot = of land=20 has already been allotted at the port for the purpose of unloading the=20 rake.

 

b)     =20 If=20 a rake is being programmed for movement to a private siding, which does = not=20 belong to the consignee, the programme should be accompanied with a = no-objection=20 certificate from the siding owner in a specified format with signature=20 (Authorised) and Rubber stamp. The siding owner should submit a list of = specimen=20 signatory (with rubber stamp) authorized to issue =93no-objection = certificate=94 by=20 the company, which will be valid for the calendar year only. Such = consent once=20 accorded shall be irrevocable except some extraordinary conditions and = the final=20 decision in this regard, shall lie with the Railways = only.

 

c)     =20 If=20 a rake is programmed for a destination that is not open for coal rake = handling=20 at that point of time, the mater would be referred to concerned zonal = Railway.=20 Before receipt of the clarification, issue of sanction of other = programmes in=20 order of seniority would continue as usual. Once the clearance is = obtained, the=20 concerned programme would be treated as the senior most programme for = sanctions=20 to be issued on that date.

 

1.12.       =20 No=20 piece meal programme will be accepted for any class of coal except=20 LOCO.

           =20 (Annexure-I ) will be received upto = 15.00 hrs.=20 on all working days for it to be processed on = date.

 

3.           = ;      =20 Amendment=20 to programmes:

 

3.1.           = ;=20 Amendment of progammes shall be done = through=20 Annexure =93D=94 and for one time only for each programme involving any = kind of=20 change. The concerned coal company should duly forward = Annexure-=93D=94.

3.2.           = ;=20 Annexure-D=20 for allotted rakes shall be processed only if supply has not already = taken=20 place. Such Annexure-d shall carry the endorsement =93amendment may be = accepted if=20 not already supplied=94.

 

3.3.           = ;=20 In=20 case of coalfields where contacts are not being issued on the basis of = coal=20 pilots, original seniority of the rake shall remain unchanged = irrespective of=20 time of submission of Annexure-=93D=94 within the time frame as = mentioned=20 above.

 

3.4.           = ;=20 In=20 case of change of pilots effected by Annexure-=93D=94 on the fields = where pilot wise=20 consent is in vogue, change of pilot will entail loss of seniority and = such=20 programmes will be accorded bottom seniority in the changed=20 pilot.

 

3.5.           = ;=20 Change=20 in the size of the rake shall be permitted when change of field is = involved.=20 Even, otherwise, Railways will consider change in rake size to suit the=20 requirement of a particular field/sidings and for other operational=20 exigencies.

 

3.6.           = ;=20 In=20 case of defective programme received by this office, the same will be = returned=20 to the Coal Company for correction and re-submission, on the same day if = possible otherwise definitely on the next working day. Programmes = re-submitted=20 after necessary correction, will get fresh = seniority.

 

3.7.           = ;=20 Change=20 of destination may be considered if it is required on account of civil = ban,=20 closure of a station for coal booking by the Railways and in case new = terminals=20 come up. However, change in destination arising out of the reasons = mentioned=20 above would be implemented through Annexure-=93D=94 = only.

 

3.8.           = ;=20 No=20 Annexure-=93D=94 will be processed during restriction period imposed on = the changed=20 destination for both allotted & non-allotted rake. Sanctioned = Annexure-=93D=94=20 shall carry the endorsement =93the destination is not under=20 restriction=94.

 

 

4.        =20 Submission of programmes on outlying = fields:

 

4.1.           = ;=20 The=20 programmes on outlying fields (SECL/MCL) for all classes of coal will be = accepted in terms of 58 BOX/N only.

 

4.2.           = ;=20 In=20 order to avoid lapsing of monthly quota and to improve loading for = industries in=20 both core/Non-core sectors, programmes pertaining to outlying field will = be=20 sanctioned in bulk.

 

4.3.           = ;=20 After=20 issue of sanction for programmes on outlying fields, the concerned zonal = Railway=20 authority in charge of allotment of rakes will deal with all issues = pertaining=20 to cancellation of allotted/unallotted rakes. Requests for cancellation = of=20 sanctioned/allotted shall not be entertained at the office of ED=20 (RM).

 

 

5.        =20 Captive Power Plant for Industrial = Units:

 

5.1.           = ;=20 Recommendation=20 from SLC/New Delhi for CPP units of Core/Non-core sector industries = would be the=20 basis for sanction of programmes.

6.        =20 Validity period of Programmes for movement of=20 coal:

 

6.1.           = ;=20 The=20 validity of sanctioned programmes for allotment and loading would be as=20 follows:

 

Industries=20 to which it will apply

Validity=20 Period of Allotment

Validity=20 for Loading

Power=20 & Interrogated Steel Plants

Month=20 to which the programmes relate.

Will=20 remain valid till 3rd of the month following month of=20 allotment.

Core=20 Sector Industries other than power and integrated steel=20 plants

Month=20 of sanction plus two months. Fore e.g. programmes sanctioned in = January=20 will be valid till end of March.

Or

Validity=20 as indicated on the body of the consented programmes received from = the=20 consent issuing company whichever is = less

Valid=20 till loaded.

Non-core=20 Sector

Month=20 of sanction plus two months. Fore e.g. programmes sanctioned in = January=20 will be valid till end of March.

Or

Validity=20 as indicated on the body of the consented programmes received from = the=20 consent issuing company whichever is = less

Valid=20 till loaded.

 

6.2.           = ;=20 Programmes once lapsed can=92t be = revived. However,=20 validity may be extended within the limit as specified in para =96 6.1 through Annexure-D if submitted = before expiry of=20 existing validity.

 

7.0.           = ;=20 Policy=20 for making allotments:

 

7.1.      The = seniority=20 will be maintained as per sanction nos. of the programmes in the = individual=20 pilot under system of pilot wise schedule.

 

7.2.           = ;=20 Separate=20 seniority will be maintained for Steam and Slack = coal.

 

7.3.           = ;=20 For=20 each subsidiary, there will be a separate = seniority.

 

7.4.           = ;=20 The=20 sanction number assigned to the programmes(s) would determine seniority = of all=20 rakes.

8.0.           = ;=20 Policy=20 for day-to-day allotment:=20

 

8.1.      = Allotment will be=20 done on the basis of pilot wise seniority of sanctions=20 issued.

 

8.2.           = ;=20 Allotment=20 of coal rakes for loading on E.Railway and E.C.Railway will continue to = be done=20 by the office of EDRM.

 

8.3.           = ;=20 Allotment=20 will be given against the sanctioned programmes on hand in the = allotment/rake=20 section.

 

8.4.           = ;=20 The=20 concerned coal company should duly forward all request(s) for = cancellation. If=20 and when the buyers/suppliers/consignees under non-core sector submit an = application for cancellation (spot cancellation) of the rake, which is = picked up=20 for allotment, the pilot will be thrown open by inviting application = from the=20 pending sanctioned programmes on that pilot, which have been duly = forwarded by=20 consenting authority. The senior most rake will be picked up for = allotment=20 against the applicants in the open pilot scheme. However, in the event = of no=20 taker being available against that particular offer from that pilot, the = offer=20 will be allowed to lapse. This will be applicable for all coalfields. = Request=20 for spot cancellations must come by 16.00 hrs. and application for open = pilot by=20 16.30 hrs. Application for cancellation will be entertained only if they = are=20 routed through concerned subsidiaries.

 

8.5.           = ;=20 Request=20 for keeping allotted rakes in abeyance shall not be entertained. If a = rake=20 cannot be loaded due to some unavoidable reason, the concerned coal = company may=20 consider withdrawing the consent for the rake.

 

8.6.           = ;=20 No=20 allotment will be given during the period of restrictions. Information = regarding=20 restriction available up to 13.00 hrs. will be considered as the latest = position=20 of restriction.

 

8.7.           = ;=20 Withdrawal=20 of offers shall not be permitted if the rakes have finally been = allotted. Coal=20 company may however, withdraw their consent, if they so=20 wish.

 

8.8.           = ;=20  No interchange/deferment of = seniority=20 will be permitted in non-core sector.

 

8.9.           = ;=20 In=20 case of Coke Fraction, allotment of rakes shall be made as per the = indents=20 placed by the Steel Plants and strictly in accordance of=20 seniority.

 

8.10.       =20 Allotment=20 of rakes for Quota point destinations will be regulated as per extant = policy=20 circulated by this office from time to time based on Board=92s = instruction in the=20 matter.

 

9.0.           = ;=20 Rules=20 for cancellation (applicable to Bengal =96 Bihar fields only served by = Eastern=20 Railway and E.C.Railway)

 

i)   Request for spot = cancellation will=20 be entertained if the same are submitted within the time limit as = indicated=20 below:

      Request = for=20 cancellation should be routed through concerned coal=20 company.

 

      Post = allotment=20 cancellation of a rake will be accepted only if the same has not been=20 supplied.

 

ii)           = ;       =20 Part=20 cancellation of rakes will not be allowed.

 

iii)           = ;     =20 Rakes=20 once cancelled and accepted by this office will not be=20 revived.

 

10.0         =20 Rules=20 for Suspension:

 

Once=20 the programme is placed under suspension as per request of Coal Company, = the=20 same will be marked =93suspended=94 on the relevant seniority list. If = the=20 suspension does not get revoked before the turn of the rake comes up for = allotment as per seniority list and a junior programme is picked up for=20 allotment then the suspended programme shall be treated as=20 lapsed.

 

11.0.    Despite whatsoever = has been=20 indicated above, EDRM/Kolkata reserves the = right to=20 cancel or withdraw/amend any sanctioned programme/rake, if he so desires = in the=20 overall interest of the Railway Administration. Further for protecting = the=20 interest of Railways, nothing mentioned above will restrict ED (RM) to = use his=20 discretion in effecting changes/amendments in the existing provisions of = this=20 policy circular.

 

           =20 The scheme enumerated above will come into effect from morning of = 1st Jan=922007.
