Waiver

 

2.1.          =20 In=20 case the consignor/consignee feels that demurrage/wharfage was due to = reasons=20 beyond his control he could apply for waiver giving all relevant details = with=20 documentary evidence wherever necessary.

 

2.2.          =20 First application for waiver = of=20 demurrage or wharfage should be submitted to the Station Manager /Goods=20 Supervisor within 10 (Ten) days from the date upto=20 which these charges had accrued.

 

2.3.          =20 In=20 case of wharfage, the consignor/consignee should first remove the = consignment=20 from the railway premises, deposit the amount of wharfage charges and = submit the=20 original proof of such payment along with his application while = preferring for=20 waiver at first instance itself.

 

2.4.          =20 The=20 concerned Station Manager / Chief Goods Supervisor will forward the = application=20 of waiver of demurrage or wharfage to the Divisional Officer together = with the=20 factual position and remarks within 3 (three) days of the receipt of the = application.

 

2.5.          =20 In=20 case of large sidings, like those of power houses, steel plants etc. the = time=20 limit for preferring the first application for waiver of demurrage = charges will=20 be the next month implying that application for waiver of demurrage = charges=20 occurred in one month should be submitted latest within the next=20 month.

 

3.0.      Appeal = against=20 orders of waiver.

 

3.1.          =20 A=20 consignor/consignee can prefer an appeal to a higher authority in case = he is not=20 satisfied with the decision of the lower authority. The Station = Manager/Chief=20 Goods Superintendent should forward the appeal to the Divisional = authorities=20 within 3 (three) days of the receipt of the = appeal.

 

3.2.          =20 However, before preferring an = appeal for=20 waiver of demurrage charges, he is required to deposit the amount of = demurrage=20 charges not waived. The original proof of such should be submitted along = with=20 the appeal.

 

3.3.          =20 An=20 appeal against the order of lower authority should be preferred within = 30=20 (thirty) days of the date when the decision of the lower authority is=20 communicated.

 

3.4.          =20 A=20 maximum of only two appeals can be made against the decision of the = lower=20 authorities.

Rates = Circular=20 No.40/2004

 

   

1.0=20       In the=20 context of limited availability of stock and the need to expedite the=20 loading/unloading of wagons, it has been decided by the Board to adept = uniform=20 working hours and business hours from 06.00 hrs. to=20 22.00 hrs. for all goods sheds/sidings on all = Zonal=20 Railways.

 

 

2.0.          =20  In-ordinate detention to wagons = placed=20 for unloading is some times caused in the goods sheds due to goods = unloaded from=20 an earlier rake lying on the ground, blocking the space for further = unloading.=20 In order to expedite removal of the goods unloaded from a rake, it has = also been=20 decided that a grace period of 2 hours beyond the prescribed permissible = free=20 time for unloading for different times of rakes would be permitted in = the goods=20 sheds for immediate removal of the entire goods unloaded from the rake = within=20 the extended grace period 2 hours. However, if a consignee does not = clear the=20 entire goods unloaded from the rake within the extended grace period of = 2 hours=20 demurrage will be leviable as per the prescribed permissible free time = and no=20 grace period in free time will be granted.

 

3.0.          =20 The=20 above guidances will not be applicable for those sidings where =93Engine = on load=94=20 scheme is being resorted as the E.O.L. norms have been advised=20 separately.

 

 

          =20 Work = Sheet for=20 calculation of Free Time for Demurrage :-

           &nbs= p;           =20 In supersession of all earlier instructions on the subject, Board = has=20 decided to revise the existing rates of demurrage, wharfage and stacking = charges=20 as under.

 

2.0.          =20 Rates of demurrage=20 charges.

 

Rates of demurrage charges per = 8 wheeled=20 wagon per hour, or part of an hour, for detention of wagon in excess of = the=20 permissible free time notified for the wagon for loading or unloading = shall be=20 as under:-

2.1.          =20 Rate structure of demurrage = charges has=20 been nationalized so that the rates for the =93next 24 hours=94 and = =93beyond 48=20 hours=94 shall be two times and three times, respectively of the rates = prescribed=20 for the =93first 24 hours=94 after expiry of permissible free=20 time.

 

2.2.          =20 The=20 rates of demurrage charges prescribed above shall be applicable equally = to all=20 types of 8 wheeled goods wagons and coaching vehicles (other than = passenger=20 vehicles), irrespective of their  = carrying capacities.

 

2.3.          =20 The=20 rates of demurrage charges in respect of 4 wheeled wagons/vehicles shall = be half=20 of the rates prescribed for the 8 wheeled wagons/ vehicles of the = respective=20 gauges.

 

The rates of demurrage charges = prescribed above should be uniformly applicable to all goods shed and = all=20 sidings including steel plants and collieries. However in the case of = steel=20 plants/collieries, where pilot to pilot system is in vogue, the revised=20 demurrage charges will be applicable on hourly basis subject to minimum=20 demurrage charges of Rs.1200/- per BG wagon.

 

2.4.          =20 Zonal Railways should = discontinue the=20 =93pilot to pilot=94 system of working in various sidings. The rakes = should be placed/withdrawn as soon as the loading/unloading = is=20 completed.

 

2.6.      It has = also been=20 decided to do away with the system of levy of higher demurrage=20 charges.

 

3.0.    Rates of = wharfage=20 charges.

 

Rates of wharfage charges per = quintal or=20 part of a quintal per day or part of a day, leviable after completion of = permissible free time for removal of goods from railway premises shall = be as=20 under:-

3.1.          =20 Permissible free time for = removal of=20 goods from railway premises at present are as = under:-

 

 

Circumstances

i)

Goods available for = delivery after=20 unloading on the day of unloading

 

12 working=20 hours

ii)

Goods, after unloading, = available=20 for delivery on the following day.

 

12 working hours or till = the=20 closing time of the goods shed on the day following=20 unloading

 

3.2.          =20 The=20 term =931st day=94 referred in para 3.0 is=20 defined as the day on which goods are available for delivery i.e. the = day of=20 unloading in reference to 3.1 (i) above and = following=20 day of unloading in reference to 3.1 (ii) above subsequent days i.e.=20 2nd day, 3rd day etc. should be counted in = reference to=20 the 1st day.

 

3.3.          =20 The=20 term =93covered shed=94 used in para 3.0 is = defined as a=20 shed having high level platform and a roof with or without the side = walls. Other=20 area meant for loading/unloading/stacking of consignment, not fulfilling = the=20 criterion of =93covered shed=94 would be treated as =93open=20 space=94.

 

3.4.          =20 It=20 has also been decided to do away with the system of levy of higher = wharfage=20 charges.

 

 

4.0.     =20 Rates of stacking=20 charges

 

Zonal Railways may permit = stacking of=20 goods in railway premises at selected goods sheds without payment of = wharfage=20 charges upto a period of ten days in advance = of=20 loading after review of traffic pattern at such goods sheds and without = causing=20 any hold to other traffic.

 

Stacking charges shall be = leviable=20 beyond the permissible advance stacking period of the days of the same = rates as=20 prescribed for wharfage charges.

 

4.1.      The = term=20 =931st day in the case of stacking charges is defined as the = day on=20 which the permissible advance stacking period is completed. For the = present=20 rules, the 10th day of stacking is, accordingly, the = 1st=20 day=94. Subsequently days i.e. 2nd day, 3rd day = etc. should=20 be counted in reference to the 1st day so defined.=20

 

5.0.      Rates = of wharfage=20 charges and stacking charges prescribed above shall be uniformly = applicable to=20 all commodities.

 

5.1.      Rates = of wharfage=20 charges and stacking charges prescribed above shall be uniformly = applicable in=20 case of all stations, goods sheds and public = sidings.

 

6.0.      These=20 instructions will be effective w.e.f.=20 20.02.2005.
